Please read this agreement carefully. By installing, launching or playing Madam Koi Koi (the "Game"), you agree to it. If you do not agree, do not install or play the Game.
1. Who We Are and What This Covers
This is an agreement between you and Glitch and Gloom Studios ("GG Studios", "we", "us"), Ajoke Street, Surulere, Lagos, Nigeria. It covers the Game, including its software, code, graphics, audio, text, story, characters, user interface and any updates we provide (together, the "Game"). It does not cover the third-party software described in Section 6, which has its own terms.
2. Your License
Subject to this agreement, we give you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and play the Game on devices that you own or control, for your personal, non-commercial entertainment.
Gameplay videos and streaming. You may record, stream and share footage of your gameplay, including on monetized platforms, and publish reviews and commentary, provided you do not present the Game as your own and do not extract, rip or redistribute its files, assets or source code.
3. What You May Not Do
You may not, and may not allow anyone else to:
- copy, sell, rent, lease, lend, sublicense or distribute the Game, or host it on any website or service for others to download or play;
- reverse engineer, decompile, disassemble or try to extract the source code of the Game, except to the extent the law expressly allows despite this restriction;
- modify the Game or create derivative works from it, or extract and reuse its code, art, audio, text, models or other assets;
- remove or change any copyright, trademark or other ownership notice in the Game;
- use the Game or any of its content for a commercial purpose, other than as allowed in Section 2;
- use the Game's content (including text, images and audio) to train or improve machine-learning or AI models;
- bypass or tamper with any technical protection in the Game; or
- use the Game in any way that breaks the law.
4. Ownership
The Game is licensed to you, not sold. Glitch and Gloom Studios and its licensors own all rights, title and interest in the Game, and this agreement does not transfer any of them to you.
The Game is inspired by the traditional West African urban legend of Madam Koi Koi. That legend belongs to shared cultural heritage, and nothing in this agreement claims ownership of it. What we own is our own expression of it: our story, characters as written in the Game, dialogue, code, artwork, music and sound, and design.
"Glitch and Gloom Studios", the GG logo and the Game's title are brand names of Glitch and Gloom Studios. All rights reserved.
5. Saved Data and Privacy
The Game saves your progress locally on your own device (for example in browser or application storage). As of this version, the Game does not collect, transmit or sell any personal data.
Clearing your browser or application data will delete your saves. We are not responsible for lost save data.
6. Third-party Software and Assets
The Game includes open-source software, including Three.js and Vite, each provided under the MIT License by its respective authors. Those components stay under their own licenses, which are reproduced in the file THIRD-PARTY-NOTICES that comes with the Game. Nothing in this agreement limits your rights under those licenses.
The Game also uses 3D models and textures from Poly Haven (polyhaven.com), released under the CC0 1.0 public domain dedication, and sound effects from Mixkit (mixkit.co), used under the Mixkit Free Sound Effects License. These are also listed in THIRD-PARTY-NOTICES.
7. Health and Content Notice
The Game contains horror themes, jumpscares, sudden loud sounds, flashing and strobing lights, references to violence and stylized depictions of death. It is recommended for players aged 16 and over.
A small percentage of people may experience seizures or blackouts when exposed to flashing lights or patterns. Stop playing immediately and consult a doctor if you experience dizziness, altered vision, disorientation, involuntary movements, convulsions or loss of awareness. Take regular breaks, and keep the volume at a safe level, especially when using headphones.
8. Updates and Availability
We may update, patch, change, suspend or discontinue the Game at any time. We have no obligation to provide updates, support or continued availability.
9. Termination
This agreement lasts until it is terminated. It ends automatically if you break any of its terms. When it ends, you must stop using the Game and delete all copies. Sections 3, 4, 5, 10, 11, 12 and 14 survive termination.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the Game is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Game will be uninterrupted, error-free or free of harmful components. Some places do not allow certain warranties to be excluded, so some of this may not apply to you.
11. Limitation of Liability
To the maximum extent permitted by law, Glitch and Gloom Studios and its contributors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of or inability to use the Game, even if we were told this could happen.
Our total liability to you for all claims relating to the Game is limited to the amount you paid for the Game in the 12 months before the claim arose, or US$50 if the Game was free.
Nothing in this agreement limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
12. Governing Law and Disputes
This agreement is governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law rules, and the courts of Lagos State, Nigeria have exclusive jurisdiction over any dispute about it. If you are a consumer, you may also have the right to bring a claim in your home jurisdiction under mandatory consumer-protection law, and nothing here removes that right.
Before starting any legal action, please contact us at glitchandgloomstudios@gmail.com and give us 30 days to try to resolve the issue.
13. Changes to This Agreement
We may update this agreement from time to time. The version number and date at the top show which version applies. Changes apply to new versions of the Game, and if you keep using the Game after we give notice of a change, you accept the updated agreement.
14. General
Entire agreement. This agreement, together with the third-party licenses in Section 6, is the whole agreement between you and us about the Game.
Severability. If any part of this agreement is found to be unenforceable, the rest stays in effect.
No waiver. If we do not enforce a right straight away, we have not given it up.
Assignment. You may not transfer this agreement or your rights under it. We may transfer ours to a successor or affiliate.
